The English translation of the General Terms and Conditions merely serves as non-binding information. Only the German version of the General Terms and Conditions is legally valid and binding.
The following General Terms and Conditions of FAU University Press in the version valid at the time of the order shall exclusively apply to the business relationship between FAU University Press and the ordering party.
The General Terms and Conditions will be deemed to have been accepted when an order is placed. These become legally binding when an order is shipped or initiated.
The prices shown are final prices in euros. They include VAT at the current rate. The publisher reserves the right to revise prices without prior notification. The revised prices will be immediately posted online. As the publications of German publishers are subject to binding retail price legislation, no discounts may be granted on the prices stipulated by the publisher. Bookstores will be granted a 30% discount on all titles available in the FAU University Press range.
Orders will usually be shipped by mail to the delivery address provided by the ordering party. Customers will be billed for the
costs of postage and packing.
FAU University Press reserves the right to cancel orders for titles that are no longer available. In this case, the ordering party will be informed at the earliest possible opportunity and any purchase price already paid will be directly reimbursed.
Customers may also reserve in advance copies of unavailable titles in the event that they are to be reprinted.
Prior to delivery, customers will be sent invoices. The invoice amount is to be transferred to the account of FAU University Press in full by the stated deadline.
Items will remain the property of FAU University Press until invoice amounts have been paid in full.
You have the right to withdraw from this contract within 14 days of its conclusion; you will not be required to provide a reason for doing so.
The cancellation period is fourteen days from the date on which you or a third party designated by you, who is not the carrier, has acquired physical possession of the items in question.
To exercise your right of withdrawal, you must send us (Universitätsbibliothek Erlangen-Nürnberg, FAU University Press, Universitätsstr. 4, 91054 Erlangen, Telefon: +49 9131 85-22155, Fax: +49 9131 85-29309, E-Mail: university-press(at)fau.de) a definitive declaration of your decision to withdraw from this contract (e.g. a letter sent by post, fax or email). You can but are not obligated to use the attached Declaration of withdrawal form. It is sufficient to dispatch your declaration of withdrawal within the cancellation period for it to be valid.
Consequences of withdrawal
If you withdraw from this contract we will return all payments that we have received from you, including shipping costs, as soon as possible and within 14 days from the date on which we receive your declaration of withdrawal from this contract. We will employ the same method used for the original transaction to return your payments unless explicitly agreed otherwise. You will not be charged for the return of your payments. We may refuse to reimburse you until you have returned the items or until you have provided proof of return of the items, whichever is earlier.
You will be obligated to return or release the items to us as soon as possible and at the latest within fourteen days from the date on which you inform us of your withdrawal from this contract. You will be deemed to have met this requirement if you dispatch the items within fourteen days. You will bear the direct costs of returning the items. You will only be liable for any reduction in the value of the items if this reduction in value is attributable to your handling of the items in a way that is not required to verify their nature, features or functions.
If items are found to be faulty on delivery, the ordering party may request the necessary rectification measures (replacement). If rectification measures prove to be ineffective, the ordering party may withdraw from the contract, reduce the purchasing price or require payment of compensation if major faults are present.
Your personal data will only be used for the purposes of order processing or to provide you with information on new offers. It will not be forwarded to third parties.
The place of fulfilment and jurisdiction for both parties shall be Erlangen.
Should one or more provisions of these General Terms and Conditions prove to be invalid in whole or part, this will have no effect on the validity of the remaining provisions. The corresponding statutory regulations will apply in place of the invalid provisions.
